Standing Together for Due Process:
Fighting Back Against Sudden ICE Detentions in Washington
The Khmer Anti-Deportation & Advocacy Group (KHAAG), in partnership with legal representatives from Columbia Legal Services, MacDonald Hoague & Bayless, Dorsey & Whitney, and the Seattle Clemency Project, is preparing to file a federal lawsuit (a group writ of habeas corpus and a complaint for injunctive relief) protect our community members from sudden and unlawful apprehensions and deportations.
Why we are filing this lawsuit
For years, many Cambodian, Laotian, Hmong, Iu Mien, and Vietnamese community members in Washington with prior removal orders have lived in our neighborhoods, raised families, and contributed to our society under orders of supervision.
Recently, ICE and the Department of Homeland Security (DHS) have begun apprehending community members without prior notice or an opportunity to be heard in court.
Our Argument
Under the U.S. Constitution, every person is entitled to Due Process. We are asking a federal court to order that ICE/DHS must provide advance notice and a fair legal hearing before taking anyone into custody, allowing community members time to seek immigration relief, apply for clemency, or prepare their families.
Who Qualifies as an Impacted Member?
You, a family member, or a loved one may qualify to benefit from this legal action if you meet all of the following criteria:
Origin: You were born in Cambodia, Laos, Vietnam, or in a South East Asian refugee camp.
Residency: You currently reside in Washington State.
Immigration Status: You have an existing final order of deportation/removal from the federal government.
Key Details for Potential Class Members
Representation by K4DP: K4DP is bringing this lawsuit on behalf of its members. The attorneys representing K4DP are not charging K4DP or our members for any legal fees or costs.
No Money Damages Involved: The purpose of this lawsuit is protection and fairness. We are seeking court orders to stop sudden arrests and force ICE to give notice and hearings, not financial compensation. If we win, a judge may order the government to pay legal fees to our attorneys.
